These Terms of Use (“Terms”) apply to the Gestalty & Friends mobile application (the “App”), the Gestalty & Friends website (the “Website”), and related content and services that we provide. Together, these are referred to as the “Services.”

The Services are operated by Gestalty & Friends (“Gestalty & Friends,” “we,” “our,” or “us”).

Please read these Terms carefully before accessing or using the Services.

Acceptance of these Terms

By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not access or use the Services.

If a child uses the App, the child’s parent or legal guardian must review and agree to these Terms on the child’s behalf. The parent or legal guardian is responsible for supervising the child’s use of the App.

By accepting these Terms, you confirm that:

• You are at least 18 years old; or

• You are the parent or legal guardian accepting these Terms for a minor using the App; and

• You have the legal authority to agree to these Terms.

About Gestalty & Friends

Gestalty & Friends provides child-led, language-rich play experiences designed to model functional language and create natural opportunities for communication.

The App includes interactive activities, prerecorded language models, sounds, illustrations, characters, and animations.

Gestalty & Friends is intended to encourage exploration, creativity, and communication through play.

Educational purpose

Gestalty & Friends is an educational play application. It is not a medical device, healthcare service, diagnostic tool, or substitute for professional care.

The Services do not provide:

• Medical advice

• A medical diagnosis

• Speech-language evaluation

• Individualized speech-language therapy

• Behavioral or developmental treatment

• Emergency assistance

The use of Gestalty & Friends does not create a healthcare provider-patient or therapist-client relationship.

Parents and caregivers should consult an appropriately qualified professional regarding questions about a child’s speech, language, development, behavior, education, or health.

Adult supervision

Gestalty & Friends is designed for young children, but the Services are made available to parents and legal guardians.

Parents and legal guardians are responsible for:

• Deciding whether the App is appropriate for their child

• Supervising their child’s use of the App and device

• Managing device settings and accessibility features

• Preventing unauthorized purchases

• Monitoring appropriate screen time

• Ensuring that the child uses the Services safely

Permitted use

Gestalty & Friends grants users a limited, personal, nonexclusive, nontransferable, and revocable right to access and use the Services for personal, family, educational, or therapeutic-support purposes, subject to these Terms.

The Services and their content may not be used for unauthorized commercial purposes.

You agree that you will not:

• Copy, reproduce, republish, sell, rent, sublicense, or commercially distribute the Services or their content

• Modify, reverse engineer, decompile, disassemble, or attempt to extract the App’s source code, except where applicable law expressly permits it

• Remove copyright, trademark, or ownership notices

• Use the Services in a way that violates applicable law

• Attempt to gain unauthorized access to the Services or related systems

• Interfere with the security or operation of the Services

• Introduce malicious code, viruses, or harmful technology

• Use automated systems to scrape or extract content

• Pretend to be associated with or officially represent Gestalty & Friends without written permission

• Use Gestalty & Friends content to create or promote a competing product

• Use the Services in a manner that infringes another person’s rights

Educators, therapists, and other professionals may use the App with children under their care, provided that they use a lawfully obtained copy and comply with applicable professional, institutional, licensing, and privacy obligations.

Ownership and intellectual property

The Services and their contents are owned by Gestalty & Friends or used with permission from their respective owners.

Protected content may include:

• The Gestalty & Friends name and logo

• Gestalty and the other characters

• Character designs and personalities

• Game concepts and presentations

• World and activity designs

• Illustrations and animations

• Language scripts and prerecorded audio

• Music and sound effects

• User-interface elements

• Text and written materials

• Graphics, icons, and visual assets

• Website design

• App software and source code

• Trademarks, service marks, and branding

Except for the limited personal-use right granted under these Terms, no ownership rights are transferred to users.

You may not use Gestalty & Friends names, characters, artwork, branding, or other protected materials for commercial purposes without prior written permission.

Feedback and suggestions

We welcome feedback from parents, caregivers, educators, therapists, and other adults.

If you voluntarily send us an idea, suggestion, comment, or other feedback, you grant Gestalty & Friends permission to use and consider that feedback without restriction or compensation to you.

Please do not send confidential information, sensitive information, or identifying information about a child.

Providing feedback does not transfer ownership of your independently created materials to Gestalty & Friends.

Our Privacy Policy forms part of these Terms. Please review it carefully before using the Services.

Internet access and device requirements

Certain features of the Services may require a compatible device, supported operating system, or internet connection.

Users are responsible for:

• Obtaining a compatible device

• Maintaining appropriate device security

• Installing available operating-system and App updates

• Paying any applicable internet or mobile-data charges

We do not guarantee that the Services will remain compatible with every device or operating-system version.

App marketplace terms

If you download the App through the Apple App Store or Google Play, your use of the App is also subject to the applicable marketplace’s terms and policies.

The applicable marketplace may be responsible for processing purchases, subscriptions, cancellations, and refunds according to its own policies.

If these Terms conflict with mandatory marketplace terms, the applicable marketplace terms will control to the extent of the conflict.

Purchases and future subscriptions

The initial version of Gestalty & Friends is free and does not require a subscription.

Gestalty & Friends may offer optional paid features or auto-renewable subscriptions in a future version.

Before a purchase or subscription is completed, the applicable purchase screen will clearly display:

• What content or features are included

• The subscription duration

• The price

• The billing frequency

• Whether a free trial is offered

• When payment will be charged

• The automatic-renewal terms

• How the subscription may be managed or canceled

Subscriptions will automatically renew unless canceled through the applicable app-marketplace account settings before the renewal date.

Payments will be charged through the user’s Apple App Store or Google Play account. Gestalty & Friends does not directly receive or store complete payment-card information.

Deleting the App does not automatically cancel an active subscription. Subscriptions must be managed or canceled through the applicable marketplace account.

Available subscription plans, prices, trials, and content may change as permitted by applicable law and marketplace policies.

Apple requires subscription apps to clearly identify the subscription duration, included content, complete renewal price, and a method for restoring purchases.

Restoring purchases

When subscription features become available, eligible purchases may be restored using the Restore Purchases option within the App.

Purchases must generally be restored using the same Apple or Google account originally used to complete the transaction.

​

Refunds

Purchases and subscriptions are processed by the applicable app marketplace.

Refund requests are generally handled according to the refund rules and procedures of the Apple App Store or Google Play. Gestalty & Friends cannot guarantee that a marketplace will approve a refund request.

App updates and changes

We may update, modify, add, remove, suspend, or discontinue parts of the Services when reasonably necessary.

This may include changes needed to:

• Add or improve activities

• Correct errors

• Maintain compatibility

• Improve safety or security

• Comply with legal requirements

• Comply with app-marketplace policies

We do not guarantee that every activity or feature will always remain available or remain unchanged.

Updates may be required to continue using certain features.

Availability of the Services

We aim to provide reliable Services, but we cannot guarantee uninterrupted or error-free operation.

The Services may occasionally be unavailable because of maintenance, updates, technical problems, circumstances outside our control, or changes to third-party systems.

Third-party services and links

The Website may include links to websites or services operated by third parties.

Gestalty & Friends does not control and is not responsible for third-party websites, services, content, privacy practices, or terms.

A link does not necessarily mean that Gestalty & Friends endorses or is affiliated with the third party.

Parents and caregivers should review third-party terms and privacy policies before using those services.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Gestalty & Friends does not guarantee that:

• The Services will always be available or error-free

• Every feature will work on every device

• The App will produce a particular educational, developmental, speech, language, behavioral, or therapeutic result

• Use of the App will meet every child’s individual needs

• All errors will be corrected immediately

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

Limitation of liability

To the fullest extent permitted by applicable law, Gestalty & Friends and its owners, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to the use of, or inability to use, the Services.

This includes, when permitted by law, loss resulting from:

• Device problems

• Interrupted access

• Loss of data

• Reliance on App content

• Unauthorized use of a device

• Third-party services

• Failure to obtain an expected educational or developmental outcome

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Responsibility for violations

You are responsible for your use of the Services and for any minor’s use of the Services under your supervision.

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your intentional misuse of the Services, violation of these Terms, or infringement of another party’s rights.

Suspension or termination

We may suspend or terminate access to the Services if we reasonably believe that a user:

• Materially violated these Terms

• Misused the Services

• Attempted to interfere with the security or operation of the Services

• Infringed our rights or the rights of another party

• Used the Services unlawfully

Users may stop using the Services at any time.

Termination does not automatically cancel an active subscription. Future subscriptions must be canceled through the applicable marketplace.

Governing law

These Terms are governed by the laws of the State of Michigan and applicable federal laws of the United States, without regard to conflict-of-law principles.

Any dispute will be handled in an appropriate court located in Michigan, unless applicable consumer law requires otherwise.

Changes to these Terms

We may update these Terms as our App, Website, services, or legal obligations change.

The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Services after updated Terms take effect constitutes acceptance of the revised Terms, where permitted by law.

If you do not agree with an updated version, you should stop using the Services.

Entire agreement

These Terms and our Privacy Policy constitute the agreement between you and Gestalty & Friends concerning your use of the Services.

If one part of these Terms is found to be unenforceable, the remaining sections will continue to apply.

Our failure to enforce a provision does not waive our right to enforce it later.
